By the authority vested in me as President of the United States of America by Sections 3301 and 3302 of Title 5 of the United States Code, and in order to permit severely physically handicapped and mentally retarded individuals to obtain civil service competitive status, Civil Service Rule 3.1 (5 CFR 3.1) is hereby amended by adding the following new subsection: "(b) Upon recommendation by the employing agency, and subject to such requirements as the Office of Personnel Management may prescribe, the following classes of handicapped employees may acquire competitive status without competitive examination: "( 1 ) A severely physically handicapped employee who completes at least two years of satisfactory service in a position excepted from the competitive service. "(2) A mentally retarded employee who completes at least two years of satisfactory service in a position excepted from the competitive service." JIMMY CARTER The White House, March 15, 1979.
